Procedures for breaches of the APS Code of Conduct

The APS Code of Conduct sets out the behavioural standards expected of APS employees. The Code is set out in section 13 of the Public Service Act 1999 (PS Act). The PS Act requires the head of each agency to establish procedures for determining whether an employee has breached the Code and what sanction, if any, is to be imposed if a breach is found.

Organ and Tissue Authority procedures

In accordance with section 15 (3) of the PS Act, the Chief Executive Officer, as the agency head of the OTA, has established procedures for determining whether an APS employee, or former employee, of the agency has breached the Code of Conduct, and for determining sanctions.

These procedures are made publicly available in accordance with section 15 (7) of the PS Act: "An Agency Head must ensure that the procedures established under subsection (3) are made publicly available". These procedures commence on 9 January 2023 and supersede previous procedures made for the OTA under subsection 15(3) of the PS Act.
